Fed: Red Cross best hope of access to captured Aussie =2

Mr Rudd told ABC radio Australia should arrange interim diplomatic representation in
Kabul to help in providing humanitarian aid and rebuilding the economy.

Meanwhile, legal experts said Hicks could be charged under Australian law with fighting
as a mercenary or fighting for the enemy, or even with treason if he had planned attacks
against Australia.

Treason carries the death penalty.

Crime Victims Support Association president Noel McNamara said Hicks deserved to pay
for his actions.

"We believe that there are some crimes that are so heinous and so unconscionable that
the death penalty is the only way out and this person is a traitor to his own country,"

he said.

"He came from a democratic country and he decided to fire against his own people and
we think he should die for that."
